Ok.. so I'm trying to read into why you would want to refinance and not let him know.. If your divorce decree gives you sole possession, then if you refinance, you would be removing him from the title, and realistically, why would either of you not want that.. the short answer is YES.. he has to sign releasing the property to you solely.. Anyone on title to the home would have to give permission for you to borrow money against it. This question brings up lots of questions as to what you are trying to accomplish here. By talking to a lender, you can tell him/her your goal and let them give you options to achieve it. Good Luck.
