joint mortgage divorce

My husband and I are getting divorced and we happen to have a joint mortgage. What is the easiest option to remove my name from the mortgage? I do not want my credit to be damaged if any payments are missed by CDevil_257_656 from Deerfield Beach, Florida. Aug 28th 2012 Reply

So by your question I have to assume that he gets the house.. By him refinancing or paying off the mortgage, he can remove your name from the obligation.. You can have your husband refinance and you will have to sign a quit claim deed at or prior to the closing on his refinance.

I reccommed that he refinance the property. Many attorney' suggest that you sign a quit claim deed however you then have a contingent liability. Not so good for you.Let me know if I can be of further assistance.Curtis

That is correct the only way to remove your self from the liability is to have him refinance in his name only.
