can husband refinance the home without wife consent?

The wife will have to sign paperwork at closing. She can prevent the refinance from happening by not signing. A person can purchase a home without their spouse signing anything but they cannot refinance without the spouse.

A Husband (or a Wife) can arrange for a loan without the other's consent. However, If the property is owned by both H&W, then the signature of the non-borrowing spouse is required to sign documents relating to the change of title that removes the non-borrowing spouse from ownership of the property. The new lender will want the ability to foreclose for non-payment, and can't do that if one of the current owners (at the time of the loan) is not on the loan. well with the limited informationa bout the legal perameters of this situation, He could if he was the only owner of the property, however if you are on the deed thn no he could not in normal circumstances. There maybe some scenarios he could but you need to seek legal advice on this matter not financial.
