i am going through a divorce and i need to get the husbands name off the deed. credit is less than perfect. what are my options?

Great question. You really need to sit down with a Lender right now, before you complete divorce settlement negotiations. A lender will evaluate your entire situation and tell you what will be needed to re-finance your soon to be "ex" off of the loan and the title. For instance, if you owe more on the house than what is is worth you may need to pay down some of the mortgage in order to refinance him off. Much better to know that now, when you can negotiate for him to contribute to this "pay down" of the mortgage loan. There are other things a lender will look for, this is the most common thing however. Make sure you are working with a lender that has done pre-approvals for divorces.

Your attorney should handle this for you.. it's as simply as typing up a disclaimer deed, which would release his ownership rights to the property and transferring them to you.. however, so long as the mortgage is open/active, the only way to get him off is to pay it off, refinance it, or sell the home... if you're unsure if you qualify or not, you should contact a local mortgage broker and apply with them.. once they see your complete profile, they should be able to guide you to the necessary steps to get approved.. You will have to refinance. First stop would be to speak with your existing lender. See what they will offer. If you have a good payment history they may help. Check to see what the home is worth versus mortgage balance. Depending on your credit scores, we can do refinance with 600. Credit scores. Mike

Working with a competent mortgage advisor and attorney can help you eliminate some hardships down the road. If all you need is to remove your husband from the deed an attorney can prepare a quit-claim deed and have him removed from ownership. However, removing him from ownership does not remove him from the mortgage loan if he is a joint borrower. To remove him from the loan you will need to complete a refinance in your name only. If credit is a major obstacle, a lender can look at the credit issues and let you know what your options are. Lenders will look at other compensating factors such as stable income, adequate collateral and liquid assets to arrive at a credit decision. You want to make sure the lender works in conjuntion with your attorney to execute the correct legal documents.

If your husband is only on deed and not mortgage you may be able to do a quit claim deed removing him from deed. If he is on the mortgage then you will need to refinance to get him off.
