They can foreclose if you have been behind on your mortgage. I would suggest speaking with an attorney and speak with your lender to discuss a loan modification as well.

The terms of your Mortgage and Note remain the same the entire life of your loan regardless of who is servicing it. I would suggest you gather your Mortgage, Note and payment history and speak to an attorney. If an attorney is not an option for you, there is a non-profit organization near you that can help. If you have stopped making your payments and have broken the terms of your Note then any servicer can start the foreclosure process. I would try to work with Deutsche Bank first and see if there are any options available for you. If not, I suggest to contact an Attorney or what Mike Silkworth suggested and contact the local HUD office. Best wishes, Sean

If you have not as yet, communicate with them and find out what they require to avoid foreclosure. Did you try to obtain a modification prior to them becoming the assignee? I am not sure how far along they are to completing a foreclosure at this point, but as have other mortgage professionals commented, by all means speak with a real estate attorney. Besides the HUD government website, www.hud.gov/offices/hsg/sfh/hcc/fc/ to direct you to someone in your area, you can search for nonprofit legal services in your area. Habitat for Humanity can be found inmany States and they can be a good resource for people with minimal finances. In Ca. there is CalHFA that provides financing to help people get through a difficult timewith an emergency "second mortgage." Perhaps the State of So. Carolina has something that.
