Yes, but keep in mind that even though HARP allows for it, lender overlay's might limit the Combined Loan to Value (CLTV), so not every lender will do it.. The best advice I can give you is to contact a LOCAL mortgage broker and apply with them. Do not use the local "Big" bank, or one of those 50 states internet lenders or nationwide lenders...By applying with your LOCAL Broker, you have an advantage because he's familiar with local customs and works with numerous lenders, seeking out the best loan terms for your particular scenario. HARP does allow for a refinance if you have a second mortgage on the property. I even did one for a borrower that had a second and a third mortgage. The real answer is will the second mortgage lender subordinate their position to the new loan. As long as your loan is Fannie Mae or Freddie Mac Owned and it was originated prior to June of 2009, yes you can refinance your 1st mortgage even if you have a second mortgage. We just have to submit a subordination request to your 2nd mortgage lender. YES! The 2nd mortgage must remain in place but you will have the benefit of today's rates when you refinance the first mortgage. You can even shorten your loan term to 15 or 20 years if you want. Call Carlo as he is local to you and sounds like he has much experience with these loans.
You sure can. I've closed several HARP refinances in the past few months that have had second mortgages. The second simply resubordinates to the new first mortgage. It's not a big deal at all.
