I'd need to change and it may vary from lender to lender. A judgment creates a title issue, not a qualification problem.

It would be good for you to consult with a mortgage broker/banker in South Carolina and get a clear picture on your qualifications and a perspective on how the judgments might be viewed by a variety of different lenders theymay represent as a broker or as a correspondent lender.

All judgement's will be required to be satisfied in order to close.. The logistics is that with a judgement that is public record, it becomes an attachment to ANY asset you have, and falls into position behind any existing encumberments.. So, when you refinance, and your existing loan get's paid off, then the judgement automatically becomes a "First Position" lien against the property.. but there's a new loan being issued and the terms of the new loan is that it must be a "First position" mortgage.. The only way for this to happen is if the judgement is paid off or if it is subordinated.. meaning the person/entity holding the judgement must agree in writing to take a 2nd position.. and in all my years of mortgage lending, I've never seen that happen.. Which is why the judgement must be paid if you wish to refinance.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona.
