I'm sorry to say, that based on what you said, you likely have no legal rights to the property. Probate is the process by which a court/judge will decide the disposition of the house, as he had no will. At this point, I suggest you contact legal aid of some sort if you wish to go before probate court and try for the house. As a lender, there is no advise i can give you as this is not a lending issue.
