What if you are in bankruptcy. It is being dismissed for failure to keep up with the program payments. Is a HARP possible?

It really depends on what the credit profile looks like.. HARP refi's will approve borrowers with recent bankruptcies, but that does not mean it will work for everyone.. HARP refi's are run through an Automated Underwriting System (AUS). This systems looks at the complete loan details as well as borrower qualifications such as credit, credit deficiencies, assets, reserves, etc.. every file is scored differently, so there's no way to know for sure without you actually applying and entering your information into the system. But this I know for sure.. you cannot do anything if your behind on your BK13 payments, and your BK has not been dismissed.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona. Bankruptcy in and of itself is a major issue... Then failing in the bankruptcy?? I don't see many underwriters approving this situation.

Based on what you tell us I concur with Brian McFedries...that you are likely going to have to qualify for a loan modification. Keep excellent records of every phone transaction and of everything you sent to your lender. You do not need to be missing any mortgage payments to qualify for a loan modification. The factthat you have had trouble keeping up with all payments in what sounds like a Chapter 13 bankruptcy ought to help make it clear to the lender you have been struggling with being able to pay all your debts. Your mortgage monthly paymentsshould come down because you ought be able to show you are struggling with too high a debt to income ratio.
