You can change it to say that your single but you may be ask to prove it.
In lending, it is understood that circumstances change. Weddings fail to occure, Marriages end in divorce, single people become married, etc. If you are not maried and state that you are, that would considered fraud. The fact that your marital status did not change is really immaterial. Go ahead and apply for the refinance, but do state that your are single, and if you are asked about why your status isn't married (which is doubtful), answer truthfully. If you are looking at an FHA streamline refinance and your former fiance is also on the current loan, that is a different issue, but otherwise the circumstance you state should not be an issue at all

I would add that if your current refinance is going to be based on the HARP program, as with an FHA streamline scenario, you will need to document that you are single & provide evidence that you have been solely responsible for the mortgage payments on your current mortgage. Curious... if you were never married, then nothing should have show you were, and you should be able to refinance as "unmarried"... The application asks your marital status at the time of application, it doesn't ask what your anticipated marital status is... WilliamAcres.com
You must change it because it would be the truth. When asked if you had a divorce, write an explaination letter of the truth. Your prvious loan officer shouldn't have put you as married on your loan application in the first place. This is your best option.
