first, if you are currently in a 13 bk, and if you are upside , or underwater on your house, and permission from the bk court, and it will benefit you as well as the trustee of the court, like you will be able to payoff your bk sooner, it can be done case by case.. i have two of them right now , that one is in process and in front of the courts, and one I am preparing to send to the courts.. linda

Your question doesn't tell us if you are currently in a Chapter 13 or if it has been dismissed. If you are in a 13, yes, after you've made at least 12 payments, and have permission from your trustee. If it is dismissed, yes right away. Of course this just addresses the bankruptcy question. You still need to go through all the other standard loan application processes before you have an approval.
In Florida you have to be out the Chapter 13 for 2 years for a VA or FHA Loan and 4 Years for a Conventional loan. If you are doing a HARP (home affordable refinance) where you are upside in your home you are allowed to be in a Chapter 13. If i am not mistaken Florida treats BK's more harshly than the rest of the country. Check with a local lender for more details.
