Alabama my husband died and the mortgage was in his name only. The deed is in both our names. There was no will or probate

How the property, on title, is vested should help you know if you can avoid probate, though I realize you are saying it is not in Probate right now. One of the most common married couple vesting is "your names as joint tenants", generally giving the survivor the inheritance of full title to the property.In regards to the mortgage, the surviving spouse can make the payments without ever necessarily refinancing it into your name.

Hello I looked on my feed and it has us listed as "tenants in common" Wouldn't that be the same as joint tenants?Also you mentioned I could keep paying the mortgage in his name, but I really want to be able to make decisions about the house.. if it isn't in my name, I won't have a decision.
