I have an eviction on my record from 2011. It doesn't show on my credit report, but it is searchable in the court records. I am looking to purchase a condo, and want to know if this will be a factor? by kristyngrasso14 from Diamond Bar, California. Sep 2nd 2015
Probably not.. but more details would be necessary to advise you properly.. typically, if the eviction also had a judgement attached to it, and the judgement is still outstanding, then it would need to be satisfied before you can get a loan.. if however the eviction did not come with a judgement, then it shouldn't be a problem.. Now if you want to know for sure, then there's only one way to find out.. You should contact a LOCAL mortgage broker and apply with them. Once they see your complete loan profile, they will be better equipped to advise you properly. Also, by applying with your LOCAL Broker, you have an advantage because he's familiar with local customs and works with many lenders with each one offering a different type of lending program. This is unlike the local bank which typically only has a few lending programs. The more lenders, the more lending options, and the more likely your scenario will be accepted.. Plus, the broker is experienced in seeking out the best loan terms for your particular scenario, and he has lower overhead which typically results in lower rates and fees than most of the larger lenders.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona. If you or someone you know is looking for financing options, feel free to contact me or pass along my information. William J. If it does not appear on your credit report then it will not be an issue, unless they have a current lawsuit against you for the amount owed or have a judgement against you, in which case you would need to disclose this in the declarations section of the Residential Loan Application (1003)Jeff Phillips

There is a possibility that it could come up. There are searches that lenders do as part of the loan approval that is entirely silent and deeper than a credit report. They are searches provided by firms such as lexisnexis and others. However, if it does come up, given the length of time since the problem, it's likely that a lender would ask you to explain the circumstances and that's it - assuming you don't owe the landlord anything.
If it doesn't show on your credit, you should be fine. However, it could be come up in title if attached to an open judgment of some sorts against you.
If it is not on your credit report then it should not affect your opportunity to buy and there should not be any negative effect on the rate that you receive. You may have to write a letter of explanation if a lender sees this when they run a Corelogic report or some other report that searches public records. But the fact that this happened in 2011 puts it in the 4 year old range. So it should not be an issue as long as there are no judgements against you from the eviction.
I hope you got the answer you were looking for! Otherwise in adding my perspectiveI suggest if you have not already gotten qualified with a mortgage broker or banker. you can do so and that professional aide in no way obligates you with that particular lender. You are welcome to shop for the best deal as well. I have donemany, many mortgage loans that successfully funded on time with worse past experiences in renting/owning than your scenario.
