Need more info and a question. Did you give back the home, or are you still in it making payments. What is the status of the loan? Current, past due, foreclosed? If foreclosed, when? I'm guessing that if you filed BK and included your home in the BK, then the 3 year waiting period starts when the home transferred out of your name, not from the discharge date of your BK.. In most situations, if you walk away from your home, BK or otherwise, the lender will sometimes take 1 to 3 years to foreclose.. Since you have zero control of when the mortgage lender decides to foreclose, you also have no control of the property coming out of your name. The clock starts when the home is foreclosed and is no longer in your name.. You can search your county recorder's office for a copy of the Trustee's Deed.. That's the date the lender will use for your 3 year waiting period.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona. As long as you have re-established credit since the bankruptcy, have had no bad credit and it has been 3 years since the discharge, you can do FHA financing if your credit score meets the lender requirements. Good Morning,To answer your question, the guidelines for FHA are once your bankruptcy has been discharged for 2 years and you have adequate credit score and re-established credit you are eligible for a mortgage with 3.5% down. As for a foreclosure, it must have been discharged 3 years.
