There's a lot missing here.. were you separated prior to filing, and how long?.. do you make enough income.. what debt does your future x spouse have that might fall back on you... your divorce attorney might say it's ok... but without seeing the complete profile, your question is impossible to answer... best advice I can give you is to first talk to your divorce attorney, and then contact a LOCAL mortgage broker, not the local "Big" bank, and certainly not one of those 50 states internet lenders... the LOCAL broker is familiar with local customs and works with numerous lenders, seeking out the best loan terms for your particular scenario. I would contact your divorce attorney..It will depend on your state community property laws, and if you are in agreementn in your divorce

You can but she will have to sign documents at closing if you are still legally married which you are until you have a recorded divorce decree. If you have a "friendly" divorce it can work, otherwise she can cause you a lot of pain to include prevent you from buying a home. Also, any bank is going to want to know child support and alimony to determine debt calculations. I am a veteran and been divorced twice. I know how this works so don't believe anyone that tells you otherwise. Your divorce attorney should be consulted, and will likely tell you to wait until the divorce is final before purchasing a new home.
