I had a mortgage with Chase, I had a loan modification for almost 2yrs payments on time due to I was on automatic deduction from m

my bank account. Know Chase has sold to Ocwen and I received a letter saying I'm going into foreclosure. How can I be in foreclosure in foreclosure if I'm up to date on my mortgage. I was told in June when I started searching for refi's that since Ocwen purchased my mortgage they couldn't change the contract it had to stay the way Chase sold it to them, and I was not in foreclosure with them. Is this a scare tactic or some sort of intimidation on Ocwens part. I'm trying to refi at this time but it seems like it's taking a long time started on June 24 and still waiting, and can they send a loan for approval without having an appraisal done not knowing the value of the home. This is a tricky situation and more info is needed. Were your automatic deductions going to Chase or Ocwen? Did you get a letter from Ocwen when they purchased your loan and did you change your automatic payments at that time? Typically if you were continuing to pay Chase you should have received a notice from them that they no longer hold the loan. You are right - when the loan is transferred from Chase to Ocwen they cannot change the terms of the loan. They can only foreclose for non-payment and they cannot send you a letter saying you are in foreclosure (against the law) if you have made your payments on time. The issue might be that your payments are still going to Chase OR Ocwen is not applying your payments correctly. You need to call Ocwen and find out what is going on. Have your loan # with Ocwen and the proof of your payments to them. This might be frustrating but you need to stay at it. Talk to a supervisor not the customer service rep who answers the phone. You need to get to the bottom of the foreclosure issue. You will not be able to refinance until that happens. If there is a pre-foreclosure on your credit report you will not be able to refinance. If you have been trying to refinance since June 24th something is wrong and it may have to do with the above problem. What company are you trying to refinance with? If the company you are trying to refi with has pulled your credit they can tell you whether you have a pre-foreclosure on the report. Yes they should be able to send you an approval without an appraisal if your credit and other factors meet the loan guidelines. The final approval will need an appraisal. You need to call Ocwen and make your July payment right away. If you are 30 days late on this payment it will destroy your chances in the refinance. If you don't pay - no matter the reason, you will get a 30 day late on your credit report and there is no way to get it off. You will have to wait 12 months to refinance. After you have done that then ask them and find out why you are getting the foreclosure letter. It is probably some type of screw up in their system - and yes - they have a reputation for bad customer service and screw ups. Read the letter carefully. It is probably a form letter and maybe they are saying you are late with your payment and if you don't pay they can foreclose. I don't believe it is a scare tactic but an aggressive way to get your payment that is now late - but not 30 days late. Typically you don't get a foreclosure letter until you are 90 to 120 days late. Make your payment and then find out why you are getting this letter. Call Ocwen.

MAKE Your payment to Ocwen and call both of them and DOCUMENT your conversations to get clarification on what they are doing. remember to Fully document person, date, time, conversation, etc.
