Fannie Mae selling my mortgage to avoid HARP?

My HELOC has recently matured (I think that's the proper term), so my once $100 / month interest only payment has jumped to $520 / month P&I. I mistakenly believed that I had five more years until that happened, so I was not prepared for this and do not have enough money each month to pay all of my bills. Additionally, my house is severely underwater. I've been working with GMAC (both first mortgage and HELOC are through them) for the past couple of months trying to find a solution to this problem. I've been in my house for thirteen years, and my mortgage has been backed by Fannie Mae for the past ten. After speaking with GMAC once again this past Friday, I find out that Fannie Mae is releasing my mortgage to Green Tree effective 2/1/13 (five days from now). I find it very hard to believe that this is "coincidentally" happening now. Is there anything that I can do?I have always had a good credit score (752 the last I checked), and have never missed any of my payments, although that will change very soon as I run out of options to generate extra money to meet my obligations. I know what is happening first hand and GMAC is releasing their servicing rights to Green Tree and Ocwen for most of their mortgage holdings which is required by their Bankruptcy filing which is now nearing completion. Fannie Mae is a clearing house for Mortgage backed Securities.. They packaged your mortgage and sold securities against it 10 years ago when you loan was originated.. So I think you're confused... Fannie Mae is not selling your loan to avoid a possible HARP refinance.. The "Servicer".. or the folks you make your payment to is changing... contact a local mortgage broker and apply with them... with a 10 year old loan, you should be able to save enough by refinancing to give you some relief... Even though Greentree will be your new servicer, it is still a Fannie Mae mortgage and can be refinanced under the Harp program. Call me at 734-395-9027 and I will be glad to go over your options. Jack Cyrul

Your "servicer" - who you make your payments to is changing to GreenTree, but the underlaying loan will still be Fannie Mae. Sit down with a local non-Bank lender to go over your options.

I would speak to a mortgage pro first then depending on what is determined then maybe speak to an attorney or loan mod specialist. Even though the servicing rights are being transferred you still may qualify under the Harp program to refinance the first.Good Luck!~

Have you tried asking GMAC if they would refinance your first loan under the Harp program? Then the next step I would take is contacting FANNIE MAE directly and seeking help from them. If your home is under water, you should have a few options open to you.Good luck sir.MG

Your loan is still owned by Fannie Mae. We can do a HARP loan for you and do not have to worry about your value. We can do HARP loans with unlimited loan to value. You will have to keep the second mtg. We cannot touch that loan. Please call me 224-420-9990.

They were given my loan as well! Green Tree is the worst company to WORK with (well they actually DO NOT WORK with you) not even to get the money you are trying to give them. They have a bunch of rude people working for them, they really need to be SHUT DOWN. I will be refinancing I don't care how my I have to pay in interest, I am not giving them a penny "F" U Green Tree!
