because of new legislation (HVCC), the current laws prohibit the buyer, agent or lender to select their own appraiser.. but rather the lender calls an appraisal management company to order the appraisal. So it wasn't your agent who hired an appraiser. but I'm making some assumptions here.. I'm guessing you hired an agent to sell your home, you're now under contract, and the appraisal did not come in as high as you hoped.. if this is the case, your agent can dispute his valuation, however keep in mind that very few times does this work.. Your agent will have to have a list of comps that the appraiser did not use for his valuation and convince him that your comps are a better representation of your homes value then what he selected.. no one likes to be told they didn't do their job correctly, so it's an uphill battle, so be prepared.. if your home was being appraised for an FHA borrower, then the value the appraiser puts on your home is stuck there for the next 120 days.. so even if you decide not to sell it to that buyer, and try to sell it to someone else for your higher number, if the new buyer is going FHA, then you have to use the value from the original appraisal if your inside of the 120 days.. if your buyer was going conventional, then If you do not accept the appraisal, you can cancel your sale to that particular buyer and the new buyer will most likely have a different lender and a different appraiser.. In reality though, you should be discussing this with your agent.. that's the person you hired to sell your home, you should be relying on their expertise to guide you in this transaction.. .. Sorry, no. The pinheads in Washington, in their infinite stupidity, have completely screwed up how appraisals work. New rules state that no one involved in the actual transaction can pick the appraiser. It has to be randomly selected. The Loan Officer can no longer pick, and you can no longer pick. If it is an FHA or VA loan, you are stuck with what you have. If it is a conventional loan, all you can do is cancel the existing application and start all over with a different lender to get a different appraisal. And of course pay for it a second time. Unfortunately, neither you or your agent are able to hire the appraiser used in the lending process. Generally speaking, when a customer's home (or home to be) is about to be appraised, I suggest that their agent create an information packet that lists all improvements and the date of improvement as well as the relevant comps in the area.I would try to find out if the appraiser was local to y'all and what comps the appraiser used. Other relevant questions would include: was the appraisal a drive-by, what size adjustments were made for your home, and why? Were they objective or subjective adjustments (e.g., square footage vs quality and condition).
The lender designates the appraiser, through an independent third party company. You can not chose; one option is to start over with a new lender, but you might get an even lower appraisal.
Actually the Lender or investor orders the appraisals via an AMC (appraisals management company) it is a 3rd party that manges the appraisers and at random.
