Can my husband refinance our house without me knowing

No conventional lender will do this. A very, very few private lenders might lend him a small amount, if there is a large equity in the home.

If you are both currently on the loan and title he most definitely can not refinance the home without you knowing. At the very least, in a private loan situation, the escrow/title companies should be demanding you sign papers even if you are not currently on the loan.

We'll we got the house in 2009 I signed and he signed for it but in 2011 he threw me out we'll I called the mortage co and they are saying they have no records of a mortage in either name how can this be?

The original mortgage company has no doubt transfered it to another serivcing company, hence they have no more record. Order a free credit report at www.ftc.gov. This will show the current servicing company, whether the loan is current, and will include their contact information.

If you are on title or on the mortgage then you would be required to sign documents in order to refinance. Other than streamline refinances, you would also be required to provide income and asset documentation.

NO, he can not refinance without your consent if you on on the loan. One to buy, two to sell or refinance. If you are married but not on the loan, he still needs your signature.

If your name is currently on the deed, then he will need you to sign acknowledging the terms of the refinance. Your lender is mistaken if they say they cannot find you, or it's possible that your loan has sold to a different lender. Ask your husband who the current lender is, and if he is not willing to tell you, you can contact a local title company and ask they to do a courtesy title search.
