Enter your answer hereMandie, there are two things at play here...first if he has a w2 for a specific year it must be filed for that specific year, you do not have the option of just filing it in the next calander year. Who ever helped you file the taxes the year you speak of can help you file a correction with the IRS you have up to 3 years to make the correction, that being said they already have a copy of the 2nd w2 as the employer is required by law to give them and you a copy of all w2 and 1099's...At anytime they could audit his taxes even after they have been accepted and you would be subject to all penalities for fraudulent tax returns. I dont mean to sound harsh, just bring it to your attention as the IRS is the last group to ever cross....... As far as the loan, more than likely you will run into trouble with your current lender you are working with, they will pull a copy of the w2's and the tax transcripts from the IRS which is standard protocol, and when they dont match it will be a red flag for the lender..... best bet is to get the taxes amended asap, to prevent any issues that may arise. Being a bank we are FDIC insured and have extra flexibility in issues like this, if you would like me to help with the loan file I would be happy to do so. I have been an FHA mortgage banker since 1998, and was certified to teach first-time homebuyers classes back in 2001. All my contact information is on my web page, feel free to contact me at anytime, i forward my office line to the cell so weekends are fine as well. thanks -John

Hello, the only problem I see is that you would have to qualify at the currently filed income until next time you file or do a amendment to your taxes.
