Will a quit claim deed remove my wife completely from the mortgage after divorce?

a quit claim deed will only remove her from the title of the home, it would still leave her liable for the mortgage payment. This really wont come into play unless she wishes to purchase a home her own in the future.. since she would still be on the loan, it would show on her credit report and would be counted as her debt, which could reduce her purchasing power for this future home.. to remove her from both the deed and the mortgage, you would need to pay off the loan, either by paying cash or refinancing.. .. First, I would recommend that you retain a lawyer and ask the question of him/her. Second, a quitclaim deed would only affect the deed. If you want to remove someone from obligation for a mortgage loan, you would have to refinance the mortgage loan. Other than that, the only exception I know of would be if your current mortgage is assumable (for example, FHA loans are assumable) then I would suggest working with that lender to remove your wife from the mortgage.

You'll need to refinance the mortgage in order to remove a person from it. A quitclaim deed will only change the way title is held. Best of luck getting everything figured out.

A quit claim deed will only remove her from the Title. If she is on the Loan currently, the only way to get her off, would be to refinance. If your divorce is not final - I would strongly advise you to speak to a Lender in cooperation with your attorney. That way, if there is money required to to close a refinance - the money needed to do so can be negotiated into the divorce agreement.

NO The only way to remove your ex-wife from the mortgage is by refinancing.

NO... I think it is a travesty that divorce lawyers do such a poor job in this area. The Quit Claim only removes her from legal ownership, not the responsibility of the loan itself.
