Your question is confusing.. if you had a property that was awarded to you in a divorce, then the attorney handling the divorce should have had him sign a deed them.. if he didn't or you didn't use an attorney, then you would have to go back to the courts and let them deal with it legally.. a LOCAL mortgage broker and apply with them. Do not use the local "Big" bank, or one of those 50 states internet lenders or nationwide lenders...By applying with your LOCAL Broker, you have an advantage because he's familiar with local customs and works with numerous lenders, seeking out the best loan terms for your particular scenario. Get legal advice from an attorey. However, if he is still obligated on the mortgage it's hard to blame him. Until he is removed from that obligation he may not be willing to sign the house over. You can do a FHA streamline refinance without a mortgage and remove him from the new mortgage and possibly remove him from the title at the same time as that closing.
