You will not be able to get a streamline refi with a modified FHA loan.. It's possible that your original lender might do it since they are already involved in the loan, but even then it would be unlikely.. more than likely your only option is to wait for the value to increase to where you can refinance and pay off all the liens against the property.. According to Mortgagee Letter 2013-16 dated May 14, 2013 released by HUD (and available on their website for verification) FHA will now accept subordination of Partial Claim promissory notes, provided the current lien position for those notes remains the same. That same letter also eliminates consideration of Partial Claim notes from the 125 percent Combined Loan-to-Value ratio calculation for FHA Streamlined Refinances. However, to be eligible for a FHA Streamline Refi you cannot have any late payments in the last 12 months. So the timeframe from a FHA-HAMP with a Partial Claim to qualify for FHA Streamline Refi would be 12 months provided you make all 12 modified payments on time.
