Since the federal government does not recognize same sex marriages, may I take a full/partial DC First Time Homebuyer credit?

I married my same-sex spouse this year and purchased a new home together. She already took the DC first time homebuyer credit for a house she owned alone. Since the federal government does not recognize same sex marriages, may I take a full/partial DC First Time Homebuyer credit since this is my first house and I have not taken the credit previously? by karenc_176_331 from Washington, District Of Columbia. I would advise you to call a cpa or your tax professional.. If you are qualifying for your new house by your self, you could take the credit, but I always advise to speak with a tax professional..

Depends on the details of how you purchased, financed, and titled the house. Also may depend on how you file your taxes. I agree with the below poster in that you MUST consult a CPA to determine.

This is a question for your Tax advisor.. However in general.. if you purchase a home with your spouse, you would qualify for at least half... assuming the DC tax credit is still in effect... I thought it ended in 2011?? best advice I can give you is to contact your local tax advisor... WilliamAcres.com

Karen - you are correct that at this time the Federal Government doesn't recognize same sex marriages (hopefully that will change sooner rather than later) but you're asking about a DC First Time Homebuyer credit and DC does recognize same sex marriages. Before checking with a tax advisor you need to check with DC and possibly your attorney to find out if you are allowed to take the credit. If the home is owned and titled in your name solely that is a different scenario than if the home is titled in both of your names. Hope this helped.
