You should consult your divorce attorney.. Laws vary from state to state, and a quitclaim deed might not be what you need to sign to transfer title in your state.. As has been said, you should contact an attorney to have that prepared for you. Be advised that removing one's name from the deed does NOT remove them from the mortgage obligation, if both husband and wife are on the mortgage. A refinancing of the property into the new sole owner's name must be done to do that. A quit claim deed will only remove a person from the deed as an owner.
STOP. Before you do anything, you need to realize that quit claiming yourself off of a title DOES NOT remove you from liability on the loan against the property. Doing so, could end up with you obligate to make payments on a piece of real estate you have no control over. If this is divorce related, you should have your own attorney and he/she should be advising you. If you don't have an attorney, go get one. If you don't, you will likely end up with a bigger problem. Hi,I am located in Ohio. A quit claim deed is prepared by an attorney. You would want to contact a title agency that either you are familiar with or just one that might be local. The title agency will have an attorney there who will prepare the quit claim for you, will have a notary there for both of you to sign (together or separately), and will also take care to ensure it is properly recorded. Of course you could contact any real estate attorney but, it'd be cheaper to contact a title agency and they would be more inclined to walk it through the final stages (recording) as they do this more often.
