Divorce Question

I am going through a divorce and want to free myself from the liability of the current mortgage in both of our names. Can I do a quit claim to accomplish this? What is the best way to get off of the loan? by annaroberts77806 from New Liberty, Kentucky. Oct 5th 2015 Reply

The only way would be to refinance your name off the loan or sell the house and payoff the loan.

You will have to have your soon to be Ex do a refinance to remove yourself from the loan. Quit Claim is only the title you will still be on the note.

A quit claim only removes you from the ownership of the property,.. it will not remove you from the liability of the loan.. the only way to do that is to somehow pay off the loan.. either by refinancing, selling or using cash reserves to pay it off, but that's the only way to get off the loan..
