Can my ex husband refinance the house without my signature?

If the deed is in both names, then he cannot refinance or sell the home without your acknowledgment.. If the home is in his name only, then yes.. he can refinance and your signature would not be required.. Because of community property rules associated with FHA and VA financing, if he is qualifying on his own without you, then the rules require a credit report from the "Non borrowing" spouse to determine if they have any additional debt that would need to be calculated in the debt to income ratios of the borrower. This would require your signature, but only to run the credit. I'm a Broker here in Scottsdale AZ and I only lend in Arizona.
