My dad left me the house when he passed but it turns out that he hadn't paid the mortgage in several months (his young gf was suppose to take of it). I want to sell it but not sure if I can now. Sorry to hear about your fathers passing. I would suggest contacting the Mortgage Lender who your fathers was making payment too and see if you can catch up on the payments before the property goes into Foreclosure. They may ask you to send them verification that you now have ownership of the property after the passing, and confirm you can take over the payments on the existing mortgage. You can sue anyone for anything but unlikely you will gain anything from it in this case unless she was stealing money and there is fraud involved. As long as the house hasn't yet been foreclosed on (normally takes a long time) you should still be able to sell it. As Scott suggested, reach out to the current lender as soon as possible. Also, you might want to consult with a estate atty if you haven't already.
