Need to back out of VA loan before it goes through.

After a very abusive episode from my husband I know I need to get a divorce. We JUST had a home appraisal go through for a home. We are literally days from closing. I am the active duty member. How can I get out of this? by sarasupastar946 from , California. Oct 6th 2014 Reply

Contact your lender. You can never be forced to take a VA loan. If you paid for the appraisal, you may not get a refund, but it is much better to learn about abuse now, rather than after the loan would have closed, as with no equity, due to no down payment, you may not have been able to sell the house, with damage to your credit.

It sounds like it may be a purchase and if you are asking how to get out of a purchase transaction days from signing that is a huge can of worms and could have big legal ramifications because you have likely removed contingencies and your deposit will likely be at risk. If it is a refinance, you have 2 choices..... ask to stop or you can sign loan docs and then sign the document that says you want to rescind. In California you have 3 days top rescind after signing loan docs if the home is owner occupied which a VA loan has to be. I am at (866) 385-1650 if you have more questions.

First Thank you for your service and sorry to hear of the situation. Tell your lender and your Realtor (if a purchase) that a personal situation makes it impossible for you to continue with the home purchase and mortgage. Potentially you could lose your earnest money deposit and any money you have already paid for the appraisal (the appraiser still has to paid) but better to lose those funds than a potentially much worse situation after closing. You should also get legal advice, it may be necessary to start some kind of legal proceedings to cancel the contract. Best wishes!

I'm very sorry to hear of your situation. You need to contact your lender and realtor right away, and let them know you cannot continue.. It's possible you will not get your earnest money refunded, and you wont get any monies back that you paid for appraisal or inspections, but these small losses are far better than the alternative..
