My Chap7 BK was "Closed" in April 2012, house was "put in" paperwork, but BK was closed ot dismissed or discharged.

Not really sure what your question is but if you had a BK and there was a home included, then FHA has a waiting period of 3 years from the time the home was transferred out of your name.. The fact that your home was included in the BK means nothing.. The waiting period begins when the home is no longer in your name.. if your BK was dismissed or discharged, then you still have to wait 3 years since there was a home involved in your insolvency.. If your home was included, you will have a 36 month waiting period from the date of discharge.

A bankruptcy that is "Closed" without being discharged, is actually "Dismissed". In the eyes of most investors, the date of the court action (dismissed or discharged) are treated the same. For FHA, the waiting period is 2 years. If you put your home in the BK, the BK was dismissed, then you still own your home. Unless you are current on your payments, the bank can foreclose because you are no longer protected by the Bankruptcy court. Hope this answered your somewhat cryptic question. When you have a bankruptcy and voluntarily "give up" the home, the bankruptcy will relieve you of the debt, but the bank still has to process (ie: foreclose) on the home. I've seen this many times up to a year after the bankruptcy discharge date.
