Mother Ill, How can I legally take her off my mortgage.

I have had my mother on my mortgage for the last 4 years, she has never contributed to the payments however. She has become ill/senile and will be placed in assisted living shortly.I do not wish to have her on the mortgage for fear she could sign my house away or get taken advantage of is someway because of the home.My issue however is that I am having a hard time getting her to sign refinance papers. additional if I get her to sign the papers, and later she comes back and her lawyer states she did not know what she was signing due to the illness, could the refinance be illegal/void?please advise by jeff93892j from San Diego, California. Jeff, if she is only on the title and not the mortgage then she can sign a quit claim form, however if she is only also on the loan which mean's her income was needed to qualify for this mortgage, you would have to do a refinance transaction without her being on the loan.

Get legal counsel. You may be able to obtain a power of attorney to handle her affairs.
