Loan qualification after Chapter 7 discharge BUT house included in BR still sits with deed.......

I received a Chapter 7 Discharge 2 years ago this August 2012. I was prepared to buy again and have established good credit and have stable and high income. I have just learned that the house that was included in the Chapter 7 might soon go to short-sale or foreclosure. (We've been waiting all this time and the Bank had done nothing with the property; I think I'm still on the deed even though I don't own the loans anymore.) Will the clock reset for me after a short-sale/foreclousure/etc? How can I get around this as it feels not right given I did what I was supposed to do and was never advised to get rid of anything else. Can I buy if I get to my two year date BEFORE the house "officially" goes under short-sale/forelosure?? Please help!! by jenn_a_689_939 from Leesburg, Virginia. Jun 11th 2012 Reply

Your waiting period for foreclosure is going to be 3 years from the date the deed is transferred out of your name.. so unfortunately for you, the clock has not even begun to tick... you would have been better off doing a short sale when you did your chapter 7.. if the home is still in your name, you can still do a short sale.. But you would need lender approval... keep in mind that the lender cannot do a "Short Sale" without your signature.. And you cannot do the short sale without their approval.. so you're stuck.. I do not believe you are still on the deed if your former home was included in the Bankruptcy and the Judge discharged you. It should not be your problem. We are also able to do persons two years out of BK in many cases. Joyce 301 915 5644/Empire thanks or email speedlad@aol.com

I HAVE TO ALSO AGREE WITH William. I have only found a few lenders that will speculate a lending on any employment under 2 and 3 years preference on a bankrupcy lend. These current 2 factors are not in your favor though your credit score is improving.
