I am going through a divorce and would like to refinance my house to get my ex-wife off the mortgage, but I've been told I cannot refinance for 2 years after the discharge. Because I am unable to refinance the house and have her named removed I am being forced to move and I have to sell the house because she does not want to wait for the 2 years to lapse before she can be removed from the mortgage. AChapter 13 bankruptcy does not disqualify a borrower from obtaining an FHA-insured mortgage, provided that the lender documents that ? one year of the pay-out period under the bankruptcy has elapsed ? the borrower's payment performance has been satisfactory and all required payments have been made on time, and ? the borrower has received written permission from bankruptcy court to enter into the mortgage transaction. TOTALScorecard Accept/Approve Recommendation Lender documentation must show two years from the discharge date of a Chapter 13 bankruptcy. If the Chapter 13 bankruptcy has not been discharged for a minimum period of two years, the loan must be downgraded to Refer. A DE underwriter would need to manually sign off on the underwrite. Just need to find a lender that would/could do it.
It is true that the normal waiting period for refinancing after a bk is 2 years, but as stated.. there is an option for a lender to do a manual underwrite.. so long as the lender has no overlays to prevent you from financing, there is a way.. Try contacting a local mortgage broker and apply with them.. brokers have access to numerous lenders, with each one offering a different lending program.. this is unlike the banks which only have a hand full of programs.. the more lenders, the more lending options and the greater likelihood your loan scenario will get accepted. Bottom line is that there are really no options other than FHA to refinance, but be prepared for a very detailed process to apply and hopefully be approved
