Most Real Estate contracts have a provision that affords the buyer the ability to inspect a home for defects. After inspection the buyer identifies the issues to be dealt with, and generally assumes responsibility for anything not identified as something to be corrected. Most states have a requirement that the seller is to identify material defects or issues the home has, such as a previous flood or fire, if they have knowledge of it. If your discovery is of something that should have been known by the seller, that they did not disclose, you may have a claim. Because each state has differing rules, the first step would be to contact the Real Estate Agent that represented you in the transaction. If you did not us a Real Estate Agent, ask your Escrow officer for guidance as to whom to contact to assist you. ~ Bert Carpenter, The LoansA2z Team of NEXA Mortgage ~ NMLS 40586 ~ Licensed in Arizona, California, Georgia, Oregon, and Washington.
