i'm on the note but not on the deed can i refinace the note

You cannot be on the note unless you were on the deed and took yourself off. If this is the case you can quit claim yourself back on at closing.

You cannot pledge a property for collateral that you do not own, so the short answer is NO. However, depending on the willingness of the current owner of the property, it might be possible to have them Deed you back on. You didn't indicate if the current owner is on the loan as well, but depending on who the current owner is, their relationship to you and whether or not they will remain on the new transaction.
