If my name is not on the title but is on the mortgage can he refinance without my signature

Since your are on the Mortgage you are also on the Deed of Trust. No he cannot Refi with out your signature.

He should not be able to, however, I have seen it happen. And what was supposedly allowed or not allowed doesn't help much once it's done. I do not know what your reason for asking is, or the exact situation. Depending on this you may want to speak to an attorney if you are trying to protect yourself against something.... For your name to NOT be on title, you would have had to remove it after the mortgage was in place. The lender will not write a mortgage without putting the borrower on title.. Did you sign a disclaimer deed or a quit claim deed? if so, then YES.. the party who is on title can refinance without your permission.. Example.. Husband and Wife purchase a home together.. both are on the title and on the mortgage. Husband and wife divorce, Wife gets the house, Judge makes Husband sign over the title to Wife.. Husband is no longer on TITLE, but he is still on the mortgage. Wife can refinance without the permission of the ex husband.
