I am eligable for a VA loan, but my wife has a judgment on her credit. Can I get a loan without paying off the judgment?

If you purchase in your name only, and you have enough income on your own to pay all the obligations of both you and your wife, then you would be ok.. if you need her income, then you would need to pay the judgment to qualify with her being added to the loan. Because of community property laws.. you must add her debt to your debt if she's not going on the loan. If you need her income to qualify, then all judgments have to be paid.. Any judgments that show up on a credit report must be satisfied before getting a mortgage loan. Have you tried to see if your income alone could qualify you to buy a home with your VA benefits?

If you do not need her income to qualify, buy the house in your name only, and add her on later.

Hello. If you are not using her on the application you probably do not have a problem, but it may create another issue for you. The issue is Texas is a Community Property state so you have to use her debts against your debt to income ratio when qualifying. If you would qualify with her debt payments and her not actually on the loan, for her income, then you would not have to pay off the judgement. If you need her income then you may just need to enter into a payment plan agreement with the holder of the judgement, show you are making payments with canceled checks and bank statements and it could be counted in the qualifying debt ratio to be able to purchase the home without paying the judgement in full. VA loans require that we include both you and your wife's debt, but if we do not add her to the loan -- then the judgment does not need to be satisfied. I've been doing VA loans for 13+ years, and lend all across Texas if you need assistance. It's a great loan with 100% financing, and no monthly mortgage insurance.
