Yes you can. But depending on how much equity will determine if you should use HARP or just a conventional refinance. There are no restrictions regarding equity in a HARP refinance, BUT... Chances are if you have equity, there are better pricing options available to you by not using HARP. Working with a seasoned local Mortgage Banker or Mortgage Broker, will allow you to compare all of your options and select the plan that works best for your situation.
