Divorce and FHA Home Loan

My girlfriend and I are trying to buy a house together. Now here's the deal, she's married but has been separated for 20 years. Her and her ex husband share nothing, no kids, no current mortgages nothing together she recently filed for divorce but will be some time before it is finalized. They will NOT require his debts to be calculated into the dti, that's simply not true. While it's true this is a requirement normally for married couples in California, it will not be in your case. The final divorce papers will also NOT be needed. A simple quit claim at closing can accomplish what you are trying to do along with a letter of explanation and copies of the filings. Yes,You must disclose that she is married and they will require a copy of his credit report and will calculate all of his debt into your ratios. You can say that she is "un married" but since that it not correct, it is considered mortgage fraud and if caught the file will get denied. I suggest getting a divorce ASAP.

I missed that you said she filled.. you can submit the paper work with the file, but most likely will be conditioned to provide the final divorce paperwork before you are approved..
