I am so sorry about your mother. You have my condolences. When someone dies without a will, it is called dying "intestate". State law requires the property go through the probate process to have legal title properly transfered to the heirs. An administrator is appointed by the probate court and it is their job to pay creditors, collect all claims against the estate, and distribute all remaining property pursuant to law. Estate laws vary by state and it is very important for you to contact an Estate Planning Attorney in your state. Hope this helps.
