The closing agent has the authority to stop a closing in the instance that the closing documents are not in the proper form or in the case where fraud is suspected by one of the transaction participants. In that instance, the closing agent is required to stop the closing, notify the lender of their findings immediately. The lender has the final authority to determine whether to proceed or not. The closing agent is supposed to be a neutral third party who role is to facilitate the closing by following the agreed upon instructions provided to them by the Buyer/Seller/Lender.In many instances in Florida, the closing agent is also the representative of the title company who will insure the transaction.
