can people with special needs (autism/retarded) buy a home via a trust?

We would like to help our son purchase a home in Michigan using a trust. We could help with the down payment, but would like our son's social security / disability checks to make the payments on the balance of the loan for the home. We are not sure if this type of purchase / financing arrangement can be done/ by jimr33 from Elkridge, Maryland. Sep 10th 2013 Reply

yes it can be done, call a local loan officer to have them explain your options.

absolutely.. so long he is of legal age, has stable provable income and sufficient credit history.. The best advice I can give you is to contact a LOCAL mortgage broker and apply with them. Do not use the local "Big" bank, or one of those 50 states internet lenders or nationwide lenders...By applying with your LOCAL Broker, you have an advantage because he's familiar with local customs and works with numerous lenders, seeking out the best loan terms for your particular scenario. Because he has lower overhead, he can offer you lower rates and lower fees than most of the larger lenders.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona. Jim, please feel free to call me to discuss. My office is located in Halethorpe, MD. If someone has the stable income, downpayment and credit to qualify for a purchase there shouldnt be an issue obtaining financing.

Hi,Yes, your son can qualify for the purchase of a new home based on stable income that will continue for at least the next 3 years, and I am sure the SS & Disability checks should work fine. The amount of the loan he can qualify for will probably be limited so you would want to verify with a lender in Michigan how much of a loan he could obtain based on his Gross income, and make sure if that income is not taxed that they gross it up which will allow him to afford a little more. Of course, affordability is the big questions. If all the down payment is coming from you, then he will need to put down at least 20% as those funds would be considered gift funds. Other financing is also available other than conventional. CHeck with a lender licensed in that state as I am only licensed in MD,DC/VA/WV. His income will have to qualify for the loan payments. He will have to be the trustor, and perhaps the beneficiary of the trust, in order for the payments to show on his credit report. Short answer: yes it can be done.
