Not these days....if that spouse is on the deed of the property the spouse has to sign new documents
Not in any state I am aware - How a home is titled to a married couple is different in all states. If you'd like to know the specifics of Pennsylvania, call a loan officer near you, they will know for sure.
If both parties are on the deed then both must consent to the refinance. During the refinance one party may be removed from the mortgage and deed with consent of both parties. That would require the remaining party to fully quality for the new note without any income or debt of the party being removed. PA law requires that the mortgage and deed match so one spouse may have a note without the partner but both parties could still be on the deed..
It depends on how the property is deeded.. if it's currently in both names, then no.. he cannot refinance without your signature. If the property is not in your name, but only his, and he does not need your income to qualify for the refinance, then he can refi without your consent..
