Getting a divorce and husband wants to refinance.

More info needed, but typically, you would want to do a refinance so you can buy out your spouse, get them their equity, and remove them from ownership... If he's just refinancing to lower the payment, then you would need to agree to sign because regardless of whether or not you are on the mortgage.. you are an owner.. he cannot refinance without your permission.. Also, if you decide to buy something in the future, you will need to disclose your ownership in this property.. if there is a mortgage, then you would need to prove to your lender that you are not responsible to pay the payments (assuming you get the property vs. him). it's even possible the lender would ask for proof that someone other than you has made the last 12 payments.. This works both ways in regards to whom ever get's the home when the divorce is finalized. By the way.. Divorce buyouts is something I specialize in.. let me know if I can help.
