More info needed,, but in general.. No.. you do not meet the definition of a first time home buyer.. For lending purposes, if you have never purchased a home, or if you have not owned a home in the last 3 years, then you would be considered a FTHB.. So, the question is, do you still own the duplex? If so, then you don't qualify.. That being said, there is a tax benefit called the Mortgage Credit Certificate (MCC).. which give's you an annual $2000 maximum tax credit for as long as you own the home and reside in it as your primary residence. However, there are some pretty stiff recapture guidelines that are attached to this certificate.. You have to reside in the home for 9 or more years to be exempt from recapture.. otherwise, you might be responsible to pay as much as 50% of the home's equity.. Other than that, there might be some local grant programs that are available to FTHB's that you would not qualify for.. My point is that there isn't as many benefits to being a FTHB as you think.. Depends on the First Time Home Buyer program you are considering. Some programs require that you not own a home for 3 years. However, Fannie Mae and Freddie Mac both allow you to Own up to 1 other home and still qualify for their First Time buyer programs called HomeReady and HomePossible. if you still own the rental - probably not ..the benefits for first time buyers are not that great

if your duplex purchase was over 3 yrs ago - then yes you should be able to be considered a first time buyer
