I divorced and I am to sell the home or have it refi-d by April. Ex is filing bankruptcy how am I affected?

I went through a divorce that finalized in January and now my ex is filing for bankruptcy and is still on the mortgage. Will I be affected by that or can I go on making payments and keep the house? by jennyd_969_784 from Bozeman, Montana. Mar 6th 2012 Reply

You need to be careful, because it could affect you... when she lists the lender as a debt, even though it's now your debt through the divorce, once your lender get's notified.. there will be added fees to your loan... You could refinance to get her name completely off the loan, or sell the property, but in any case, if she lists the debt, which she's required to do, you will pay for it... WilliamAcres.com

You need to speak to an attorney who specializes in Real estate law in your state, but seems like you need to quit claim him off the deed and refi on your own if you qualify, also seek out a local mortgage broker who can shop all the banks for your best interest..Good Luck

Keep making the payments! If you don't it will affect your credit. You should make sure that your soon to be ex is off of the property completly so that none of their creditors can attach a lien to the property. It is advisable to get refinanced as soon as possible if both of you are on the current mortgage.

Be very careful here. If you were awarded the home, and you keep making the payments on time, you should be OK.
